Acceptance of terms

Thank you for using Zuloro. These Terms of Service (the “Terms”) are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the Zuloro website at www.zuloro.in (the “Site”) and any related mobile or software applications (“Zuloro Platform”) including but not limited to delivery of information via the website whether existing now or in the future that link to the Terms (collectively, the “Services”).

Please read these Terms carefully. By accessing or using the Zuloro Platform, you are agreeing to these Terms and concluding a legally binding contract with Zuloro a service platform of company Caruvi Solutions Pvt. Ltd. and/or its affiliates (hereinafter collectively referred to as “Zuloro” means Service platform or a online delivery business model of company Caruvi solutions Pvt. ltd.). You may not use the Services if you do not accept the Terms or are unable to be bound by the Terms. Your use of the Zuloro Platform is at your own risk; including the risk that you might be exposed to content that is objectionable, or otherwise inappropriate.

In order to use the Services, you must first agree to the Terms. You can accept the Terms by:

Clicking to accept or agree to the Terms, where it is made available to you by Zuloro in the user interface for any particular Service; or

Actually using the Services. In this case, you understand and agree that Zuloro will treat your use of the Services as acceptance of the Terms from that point onwards

Definitions:

Zuloro Online Platform:

Zuloro online platform means an App using via customer to purchase food thali online and restaurant getting order from customer by using Zuloro platform.  And Zuloro business model is maintained/Powered by Company “Caruvi Solutions Pvt. Ltd.”

Customer:

Customer means you, who is accessing our Zuloro platform for ordering online food order or connected to our platform though viewing or using services in any way.

Restaurant:

Restaurant mean restaurant listed or registered with in Zuloro online service platform.

 Eligibility to use the services

You hereby represent and warrant that you are at least eighteen (18) years of age or above and are fully able and competent to understand and agree the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.

Use of Platform and Services

It is clearly known to Restaurants listed on our platform and Customer who are ordering any order that Zuloro is just a platform making bridge between customer and Restaurants for full filling order requirement via delivery channel and routing payment from customer end to all partners via Zuloro platform managed by company Caruvi Solutions Pvt. Ltd.  .   All commercial/contractual terms are offered by and agreed to between Buyers and Merchants alone with respect to products and services being offered by the Merchants. Zuloro Platform does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Merchants. Zuloro platform may, however, offer support services to Merchants in respect to Order fulfillment, mode of payment, payment collection, call Centre support and other ancillary services, pursuant to independent contracts executed by Zuloro with the Merchants. The price of the product and services offered by the Merchant are determined by the Merchant itself and Zuloro platform includes the additional margin on each order for providing deliver channel support.

Zuloro does not make any representation or warranty as to the item-specifics (such as legal title, creditworthiness, identity, etc.) of any of the Merchants. You are advised to independently verify the bona fides of any particular Merchant that you choose to deal with on the Platform and use your best judgment on that behalf.

Please note that there could be risks in dealing with underage persons or people acting under false pretense.

Where Zuloro is facilitating delivery of an order placed by you (Customer), Zuloro (Caruvi Solutions Pvt. Ltd.) shall not be liable for any acts or commissions on part of the Delivery Partner including deficiency in service, wrong delivery of order, time taken to deliver the order, order package tampering, etc.

Zuloro Platform  shall not be liable for any acts or omissions on part of the Restaurant Partner/Store(s) including deficiency in service, wrong delivery of order / order mismatch, quality, incorrect pricing, deficient quantity, time taken to prepare or deliver the order, etc.

Please note that some of the food and beverages or Products may be suitable for certain ages only. You should check the dish you are ordering and read its description, if provided, prior to placing your order. Zuloro (Caruvi Solutions Pvt. Ltd.) shall not be liable in the event the food and beverages or the Product ordered by You/Customer does not meet your dietary or any other requirements and/or restrictions.

While placing an order you shall be required to provide certain details, including without limitation, contact number and delivery address. You agree to take particular care when providing these details and warrant that these details are accurate and complete at the time of placing an Order. By providing these details, you express your acceptance to Zuloro terms and privacy policies.

Delivery periods/Takeaway time quoted at the time of ordering are approximate only and may vary.

Product liability of goods provided by Restaurant partners.

Customer (Ordering food) and Merchants agree and acknowledge that Zuloro Platform is not responsible for any liability arising out of delivery services provided by Delivery Channel to them.

Customer (Ordering food) understands that delivery time quoted at the time of confirming the Order is an approximate estimate and may vary based on the information obtained from PDPs and Merchants. Zuloro (company) will not be responsible for any delay in the delivery of an Order.

Customer (Ordering food) Order will be only delivered to the address designated by him/her at the time of placing the Order on the Platform. Customer Order will be cancelled in the event of any change of the address as informed by the delivery partner and Customer shall not be entitled to any refund for the same. Delivery of goods and services in the event of change of the delivery location shall be subject to acceptance by the Delivery partner or sole discretion of Zuloro Platform.

The Customer (Ordering food) understands that Zuloro Platform (including Restaurant’s and Delivery partner’s) liability ends once Order has been delivered to him/her, except where the product liability of the Restaurants subsists. 

Order cancellation Policy terms (Refund policy) & condition

Once customer order Placed for any order via Zuloro Platform, order cancellation can be done only till Order not accepted restaurant, Once order Accepted by restaurant means restaurant stared making food order, So after that Customer will have no Option to cancel order in any ways as to stop food wastage. In case Customer has any feedback for Food quality or other reason, Customer may give rating and review online from where order placed. If Company found more than 5 –ve rating or genuine –ve feedback Company will have full right to deregister restaurant from Zuloro platform without any prior notice.

Again reminding it is well known to customer that in Zuloro platform have no option of cancelling order or refund money once order accepted by restaurants. No replacement / refund / or any other resolution will be provided without Restaurant Partner’s/Store(s)’ permission.

 Guidelines About Shipping Order & Invoices

  As we are a food aggregator business module.  We do not require Billing or Shipping to be done manually. Billing we provide to our customer digitally in APP with invoice download option.  And the address of our customer we fetch through Google API that saves in our server to put in invoice and further uses. Shipping  of Order Will be done by Delivery Partner.

Zuloro Website and App using condition:

You agree, undertake and confirm that your use of Platform shall be strictly governed by the following binding principles:

You shall not host, display, upload, download, modify, publish, transmit, update or share any information which:

belongs to another person and which you do not have any right to; is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, slanderous, criminally inciting or invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;

is misleading or misrepresentative in any way;

is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;

harasses or advocates harassment of another person;

involves the transmission of “junk mail”, “chain letters”, or unsolicited mass mailing or “spamming”;

promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

infringes upon or violates any third party’s rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, email address, physical address or phone number) or rights of publicity;

promotes an illegal or unauthorized copy of another person’s copyrighted work (see “copyright complaint” below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);

Provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;

Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;

Contains video, photographs, or images of another person (with a minor or an adult);

tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

Engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of products related to the Platform. Throughout these Terms of Use, (Zuloro) Caruvi Solutions pvt. ltd. prior written consent means a communication coming from (Zuloro) Caruvi Solutions Pvt. Ltd.’s Legal Department, specifically in response to your request, and expressly addressing and allowing the activity or conduct for which you seek authorization;

solicits gambling or engages in any gambling activity which is or could be construed as being illegal;

interferes with another user’s use and enjoyment of the Platform or any third party’s user and enjoyment of similar services;

refers to any website or URL that, in our sole discretion, contains material that is inappropriate for the Platform or any other website, contains content that would be prohibited or violates the letter or spirit of these Terms of Use;

harm minors in any way;

infringes any patent, trademark, copyright or other intellectual property rights or third party’s trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;

Violates any law for the time being in force;

Deceives or misleads the addressee/users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

Impersonate another person;

contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;

threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any criminal offence or prevents investigation of any offence or is insulting any other nation;

Is false, inaccurate or misleading;

directly or indirectly, offers, attempts to offer, trades or attempts to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force; or

Creates liability for us or causes us to lose (in whole or in part) the services of our internet service provider or other suppliers.

You shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform. We reserve our right to prohibit any such activity.

You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, “password mining” or any other illegitimate means.

Account Registration 

By creating an account, you agree to receive certain communications in connection with Zuloro (Caruvi Solutions Pvt. Ltd.) Platform or Services. For example, you might receive comments from other Customers or other Customers may follow the activity to do on your account. You can opt-out or manage your preferences regarding non-essential communications through account settings.

 Customer Reviews

Customer reviews or ratings for Restaurants do not reflect the opinion of Zuloro (Caruvi Solutions pvt. Ltd.). Zuloro receives multiple reviews or ratings for Restaurants by Customers, which reflect the opinions of the Customers. It is pertinent to state that each and every review posted on Zuloro is the personal opinion of the Customer/reviewer only. Zuloro Platform is a neutral platform, which solely provides a means of communication between Customers/reviewers including Customers or restaurant owners/representatives with access to restaurant business page. The advertisements published on the Zuloro Platform are independent of the reviews received by such advertisers

We are a neutral platform and we don’t arbitrate disputes, however in case if someone writes a review that the restaurant does not consider to be true, the best option for the restaurant representative would be to contact the reviewer or post a public response in order to clear up any misunderstandings. If the Restaurant believes that any particular Customer’s review violates any of the Zuloro policies, the restaurant may write to us at Support.orderthali@gmail.com  and bring such violation to our attention. Zuloro (Caruvi Solutions Pvt. ltd.) may remove the review in its sole discretion if review is in violation of the Terms, or content guidelines and policies or otherwise harmful to the Services

Privacy Policy

You represent that you have read, understood and agreed to our Privacy Policy. Please note that we may disclose information about you to third parties or government authorities if we believe that such a disclosure is reasonably necessary to (i) take action regarding suspected illegal activities; (ii) enforce or apply our Terms and Privacy Policy; (iii) comply with legal process or other government inquiry, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process/notice served on us; or (iv) protect our rights, reputation, and property, or that of our Customers, affiliates, or the general public

Advertising

Some of the Services are supported by advertising revenue and may display advertisements and promotions. These advertisements may be targeted to the content of information stored on the Services, queries made through the Services or other information. The manner, mode and extent of advertising by Zuloro (Caruvi Solutions Pvt. Ltd.) on the Services are subject to change without specific notice to you. In consideration for Zuloro Platform  granting you access to and use of the Services, you agree that Zuloro Platform may place such advertising on the Services.

Zuloro Platform and or mobile apps, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, shall be solely between you and such advertiser. Zuloro Platform will not be responsible or liable for any error or omission, inaccuracy in advertising material or any loss or damage of any sort incurred as a result of any such dealings or as a result of the presence of such other advertiser(s) on the Zuloro Platform and mobile application.

Once delivery channel partner, restaurant partner, Zuloro franchisee, customer, accept our Terms and condition it means they agrees to use their data (Mail, contact mobile No.)Zuloro platform (Caruvi Solutions Pvt. Ltd.) for advertisement and send any data like Third party advertisement, or any information via Zuloro platform, mail, Whatsup, SMS, or any digital platform. 

Online Rate displayed of Restaurant Partners:

Rates/price displayed of all category  food thali of restaurant rate may changed any time, Zuloro will try up to date all rates latest, In case Restaurants partner change  price it will be applicable to all customers.

Zuloro Services:

1. Definitions

• “Platform” refers to the Zuloro website and mobile application.
• “Vendor” refers to businesses and service providers who list their services on the Zuloro platform.
• “Customer” refers to individuals using the platform to avail services.
• “Zuloro Services” refers to the range of local service listings, including hospitals, ATMs, vehicle services, entertainment zones, medical shops, etc.

2. General Terms

• By using the Zuloro platform, you agree to comply with all applicable laws and regulations.
• Zuloro reserves the right to update or modify these terms at any time without prior notice.
• Continued use of the platform after modifications constitutes acceptance of the revised terms.

3. Vendor Terms

3.1 Vendor Registration

• Vendors must provide accurate business details during registration.
• Zuloro reserves the right to verify, approve, or reject vendor registrations.

3.2 Vendor Responsibilities:

• Vendors must ensure service accuracy and update details as needed.
• Any disputes between vendors and customers must be resolved directly. Zuloro will not be liable for service-related complaints.
• Vendors must comply with local business regulations and service standards.

3.3 Vendor Removal & Suspension:

• Zuloro reserves the right to remove or suspend a vendor listing if it violates platform policies or receives repeated complaints.
• No refunds will be issued for removed or suspended vendor accounts due to policy violations.

4. Customer Terms

4.1 Service Usage:

• Customers can search and use the listed services at their discretion.
• Zuloro provides service information but does not guarantee service quality or availability.

4.2 Customer Responsibilities:

• Customers must verify the service details before availing.
• Any issues with vendors should be reported to Zuloro, but the company holds no liability for vendor actions.

5. Limitation of Liability

• Zuloro acts as a platform for connecting customers with service providers and does not guarantee any service quality, pricing, or accuracy.
• The company shall not be liable for any loss, damage, or disputes arising from vendor-customer interactions.

6. Privacy & Data Protection

• Zuloro collects and processes data as per its Privacy Policy.
• User information is used only for service facilitation and platform improvements.

Zuloro Gift policy:

Customer /You may place an online order with a Restaurant Partner and delivery boy may give a random gift, That gift can be any random gift given by company to encourage our valuable customers, It is not any mandate or compulsory to show gift in Zuloro platform or provide on each order, It totally depends on company to give random gift or not. On random free gift their no liability or warrant or service support from company for which Customer, Restaurants partner, delivery partner, or franchisee can claim.

If  due to any reason if any customer or partner having any issue or dispute happed shall be governed under the jurisdiction of the state of Kitara, Uttrakhand only
